US- Musterprozess: Free Speech gewinnt

Die American Civil Liberties Union hat den Musterprozess
gegen die Behörden in Loudon County, Virginia gewonnen.
Ab dato ist es illegal, in öffentlichen US-Bibliotheken Internet-
Zugang nur mit Filtersoftware anzubieten. Ehschonwissen:
First Amendment (free speech) overrules.

Folks- We will post the official news soon but thought some
of you may be pleased to know that we just received word
that the judge in Loudoun granted our motion for summary
judgment finding the library policy that requires the use of
filters on all terminals is unconstitutional. Cassidy

November 23, 1998, 2:55 p.m. PT In a precedent-setting
decision, a federal court in Virginia ruled today that it is
unconstitutional for a public library to filter Net access for all
patrons.

Siding with civil liberties groups, U.S. District Judge Leonie
Brinkema struck down Loudoun County Public Library's
policy to install X-Stop blocking software on every computer
with a Net connection in an effort to bar access to sites
deemed "harmful to minors."

Brinkema said that "such a policy offends the guarantee of
free speech in the First Amendment and is therefore
unconstitutional."

The closely-watched case was the first constitutional
challenge to library Net filtering, an issue that has been
debated throughout the country.

Libraries have been pushed to the front lines of the online
censorship battle since the Supreme Court last June struck
down the Communications Decency Act, which made it a
felony to provide "indecent" material to minors via the Net.
